Terms of Service

These terms are a legal agreement between you and TemKeep governing your use of the TemKeep website and mobile app (the "Service"). By using the Service you agree to them.
1. Eligibility and accounts
You must be at least 18 and able to form a binding contract. You are responsible for keeping your login details secure and for all activity under your account. Tell us promptly at privacy@temkeep.com if you suspect unauthorised use.
2. The Service
TemKeep lets you record temperature and other food-safety checks, attach notes and photos, and export records (for example as a PDF). Thresholds and templates follow general UK FSA and US FDA guidance, but they are provided for convenience only and may not reflect every local rule.
3. Your responsibilities
- Enter accurate readings and information.
- Confirm the correct thresholds and procedures with your local authority or environmental health officer.
- Keep your own backups of records you are legally required to retain.
- Use the Service lawfully and only for legitimate food-safety record-keeping.
4. Acceptable use
You agree not to: break the law; infringe others' rights; upload malware; attempt to gain unauthorised access; reverse-engineer or resell the Service except as allowed by law; falsify records to deceive an inspector or third party; or use the Service in a way that disrupts it for others.
5. Subscriptions, billing and cancellation
- Paid plans are billed in advance on a recurring basis (monthly or annual) at the price shown at sign-up. Prices and plans may change with notice.
- Subscriptions renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period.
- Except where required by law, payments are non-refundable for partial periods.
- If you bought through the Apple App Store or Google Play, billing, renewals and refunds are also subject to that store's terms.
6. Free trials and early access
We may offer trials or early-access features. These may change or end at any time, and early-access features may be incomplete or unstable.
7. Intellectual property
The Service, including its software, design, and content, belongs to TemKeep and its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your business. The records and content you create remain yours; you grant us the limited rights needed to host and display them back to you and to provide the Service.
8. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. We do not warrant that using TemKeep will make you compliant with any law, standard, or inspection. You are solely responsible for your food-safety compliance.
9. Limitation of liability
To the fullest extent permitted by law, TemKeep will not be liable for any indirect, incidental, special or consequential losses, or for loss of profits, goodwill, data, or any fines or penalties imposed by an authority. Our total liability arising out of or relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or £100 / $100. Nothing in these terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or fraud).
10. Indemnity
You agree to indemnify TemKeep against claims and costs arising from your misuse of the Service or breach of these terms.
11. Suspension and termination
You may stop using the Service at any time. We may suspend or end your access if you breach these terms or to protect the Service. You can export your records before closing your account; see Account & Data Deletion.
12. Changes to these terms
We may update these terms. We will post the new version with a revised date and, for material changes, give reasonable notice. Continuing to use the Service means you accept the updated terms.
13. Governing law
If you are in the UK or EU, these terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are in the United States, these terms are governed by the laws of the state in which TemKeep is established, without regard to conflict-of-laws rules, and you and TemKeep submit to the courts located there. Mandatory consumer-protection rights in your country of residence are unaffected.
