Privacy Policy

This policy explains what personal data TemKeep ("TemKeep", "we", "us") collects, why, who we share it with, and the rights you have. It covers both our website (www.temkeep.com) and the TemKeep mobile app.
1. Who we are
TemKeep is operated by Viva Labs, a sole trader (an individual operating under the trading name "Viva Labs") based in India. We provide a food-safety record-keeping app and related website for small food businesses in the United Kingdom and United States. Viva Labs is the data controller of the personal data described in this policy.
Because we are based in India and offer our service to people in the United Kingdom, the EU and the United States, we comply with the UK GDPR and EU GDPR and applicable US state privacy laws for those users, and with India's Digital Personal Data Protection Act 2023 where it applies.

2. Data we collect
a. When you join the early-access list (website)
- Email address, and the region (UK/US) and page you signed up from.
b. When you use the app
- Account data: email address and any name or business name you provide.
- Food-safety records you create: temperature readings, check times, corrective actions, notes, and any photos you attach.
- Business profile: site/location names and the region settings you choose.
c. Automatically
- Analytics: anonymous usage data via Google Analytics 4 — but only if you accept analytics cookies (see our Cookie Policy). This includes approximate location (country/region), device/browser type, and pages viewed.
- Technical logs: our hosting provider processes IP addresses and request metadata to deliver and secure the service.
3. Why we use your data and our legal bases

You can withdraw consent at any time (e.g. unsubscribe from emails, or decline analytics cookies) without affecting processing already carried out.
4. Who we share your data with
We do not sell your personal data. We share it only with service providers ("processors") who help us run TemKeep, under contracts that require them to protect it:
- Cloudflare — website hosting, CDN and security.
- Amazon Web Services (Amazon SES) — sending transactional and signup emails.
- Google (Google Analytics) — website/app analytics, only with your consent.
- Our app hosting and database provider — storing your account and records.
- Our payment processor — handling subscription payments (we do not store full card details).
We may also disclose data where required by law, to enforce our terms, or as part of a business transfer (e.g. merger or acquisition), in which case we will tell you.
5. International transfers
Some of our providers (e.g. Google and AWS) may process data on servers in the United States or other countries outside the UK/EEA. Where we transfer personal data internationally, we rely on appropriate safeguards such as the UK International Data Transfer Agreement / Addendum, the EU Standard Contractual Clauses, or an adequacy decision.
6. How long we keep your data
- Early-access emails: until launch and for a reasonable period after, or until you unsubscribe or ask us to delete them.
- Account and records: for as long as your account is active. If you close your account or ask us to delete it, we remove your data within 30 days, except where we must keep limited records to meet legal obligations.
- Analytics: retained per Google Analytics settings (default up to 14 months).

7. Security
We protect your data with encryption in transit (HTTPS/TLS), access controls, and reputable infrastructure providers. No method of transmission or storage is completely secure, but we work to protect your information and to notify you and the relevant regulator of any breach where the law requires.
8. Your rights (UK & EU)
If you are in the UK or EU, you have the right to: access your data; correct it; erase it; restrict or object to processing; data portability; and withdraw consent. To exercise any right, email privacy@temkeep.com. We respond within one month.
You also have the right to complain to a supervisory authority. In the UK this is the Information Commissioner's Office (ICO), ico.org.uk. In the EU it is your local data protection authority.
9. Your rights (United States / California)
Depending on your state (including under the California Consumer Privacy Act as amended by the CPRA), you may have the right to: know what personal information we collect and how it is used; access or delete it; correct it; and opt out of "sale" or "sharing" of personal information.
We do not sell or share your personal information as those terms are defined under US privacy laws, and we do not use it for cross-context behavioural advertising. We will not discriminate against you for exercising your rights. To make a request, email privacy@temkeep.com.
10. Children
TemKeep is a business tool and is not directed to children. We do not knowingly collect personal data from anyone under 16. If you believe a child has provided us data, contact us and we will delete it.
11. Changes to this policy
We may update this policy from time to time. We will post the new version here with a revised "last updated" date, and for significant changes we will give additional notice.
